AOD eLink Home Banking Terms and Conditions
This Agreement governs the use of AOD eLink Home Banking, referred to as the "Service," provided by AOD Federal Credit Union. By using the Service to conduct banking transactions, you agree to the terms of this Agreement.
 
Definitions
 
As used in this Agreement, "account" and "accounts" mean the AOD Federal Credit Union account(s) tied to your account number used through the Service to conduct banking transactions. "Loan account" and "loan accounts" means any loan you have with AOD Federal Credit Union. "You," "your," and "yours" mean the person(s) using the Service. "We," "our," us," and "credit union" refers to AOD Federal Credit Union.

Deposit and Credit Agreements
 
The terms and conditions in this Agreement are in addition to any deposit and loan account agreements you have with the credit union, including without limitations, your deposit account agreement, AOD Federal Credit Unions' rules and regulations for deposit accounts, as amended, AOD Federal Credit Unions' Fee Schedule or any accompanying schedules, AOD Federal Credit Unions' Electronic Fund Transfer Disclosure (together the "Deposit Agreement"), any overdraft protection agreement, any loan agreement you have with AOD Federal Credit Union and any change of terms notices.
 
Required Equipment
 
In order to use the Service, you need a computer (in this Agreement, your computer and the related equipment are referred to together as your "Computer.") with a web browser (either Netscape Navigator 4.0 or higher, Microsoft Internet Explorer 4.0 or higher, or AOL 3.0 or higher), an account number, and PIN. The initial PIN used to access the service is the confidential personal identification number you use to access VoiceLink Telephone Banking. You are responsible for the installation, maintenance, and operation of your Computer, browser and the software. AOD Federal Credit Union is not responsible for any errors or failures from any malfunction of your computer, the browser or the software. AOD Federal Credit Union is also not responsible for any computer virus or related problems that may be associated with the use of an online system.
 
The Service
 
To use the Service, you must have at least one AOD Federal Credit Union deposit account. Through the Service, you will have access to any of your AOD Federal Credit Union deposit accounts or loan accounts. AOD Federal Credit Union reserves the right to deny access to a deposit account or loan account or to deny transactions under certain circumstances.
 
Description of the Service
 
The Service allows you to perform some or all of the following functions from your Computer:
 
Online Account Access Functions
 
You may use the Service to (a) transfer funds between your accounts; (b) obtain account balances; (c) obtain transaction information for your accounts; and (d) obtain loan account balance information. These features are limited to the extent, and subject to the terms, noted below.

i. Your ability to transfer funds between certain accounts is limited by federal law and the Deposit Agreement. You should refer to the Truth in Savings and/or Electronic Funds Transfer Disclosures for legal restrictions and service charges applicable for excessive withdrawals or transfers. Transfers made using the Service are counted against the permissible number of transfers described in these Agreements.
ii. Transactional information for your accounts will be available from the Service for a maximum of three statement cycles prior to the date of inquiry.
 
Exclusion of Warranties
 
This Service and related documentation are provided "as is" without any warranty of any particular kind either expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose.
 
Personal Identification Number and Security
 
Your personal identification number (PIN) is required to access AOD eLink Home Banking. It is the same PIN you use to access our VoiceLink Telephone Banking. You are allowed and encouraged to change your PIN. Changing your PIN in AOD eLink Home Banking will not change your VoiceLink Telephone Banking PIN. You agree not to give or make available your PIN to any unauthorized individual. If you believe your PIN has been lost or stolen, someone has attempted to use the Service without your consent, your account(s) or loan accounts have been accessed, or someone has transferred money without your permission, you must notify AOD Federal Credit Union immediately (see Contact Information below). AOD Federal Credit Union does not maintain a record of your PIN. If you lose or forget your PIN, contact AOD Federal Credit Union immediately so that you may be issued a new confidential PIN.
 
In an effort to provide the highest degree of confidentiality and security, AOD Federal Credit Union recommends the use of browsers that provide encryption using a 128-bit key. The higher the level of encryption, the harder it is for unauthorized people to read information. Commercial off-the-shelf browsers typically support 40-bit encryption; however, many browser suppliers (Netscape and Microsoft) offer special 128-bit encryption versions, available for download from their respective web sites. AOD Federal Credit Union recommends that Members protect their valuable financial information by using the most secure encryption possible. AOD Federal Credit Union is not liable for losses resulting from the use of 40-bit encryption. AOD Federal Credit Union is only liable for losses resulting from unauthorized transactions if it does not follow reasonable security procedures. If you elect to use the 40-bit browser, this implies your acceptance of this risk.
 
Your Liability for Unauthorized Payments
 
You could lose all the money in your account(s) plus your maximum overdraft line of credit, if any, through an unauthorized banking transaction or payment. Therefore, you should contact AOD Federal Credit Union immediately if you believe your PIN or account number(s) has been lost or stolen, if an unauthorized person has learned your PIN and/or account number(s), if you believe your account(s) has been accessed and/or someone has performed an unauthorized transaction from your account. Notifying AOD Federal Credit Union immediately by phone could minimize your possible losses.
 
If you notify AOD Federal Credit Union within two (2) business days of an unauthorized transaction, your maximum liability will be $50. If you do not tell us within two (2) business days after you learn of the loss or theft of your PIN and/or account number(s), and we can prove we could have stopped someone from accessing your account(s) without your permission if you had notified us, then you could lose as much as $500.
 
Also, should your statement show banking transactions that you did not make or authorize, please tell us immediately. If you do not tell us within 60 days after the statement was mailed, you may not get back any of the money you lost if we can show that we could have stopped the unauthorized banking transaction(s) or payment(s) if you had notified us in time.
 
You agree to assist AOD Federal Credit Union in its efforts to recover any funds that were transferred or paid without your permission or consent.
 
Errors and Questions
 
In case of errors or if you have questions about the Service or banking transactions, you must notify us at once (see Contact Information below). We must hear from you no later than 60 days after we send you the first statement on which the problem or error appeared. For all errors, you must:
 
1. Tell us your name, account number(s), loan number(s) (if applicable), and address;
 
2. Describe the error of the transaction which you are unsure, and explain as clearly as you can why you believe it is an error or why you need more information; and
 
3. Tell us the dollar amount of the suspected error.
 
If you tell us orally, we may require that you send your complaint or question, in writing, within ten (10) business days.
 
We will tell you the results of our investigation within ten (10) business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 45 days to investigate the complaint or question. If we decide to do this, we will credit your account within ten (10) business days for the amount you think is in error, so that you may have the use of the money during the time it takes us to complete our investigation. If we ask you to put your complaint or question in writing and we do not receive it within ten (10) business days, we may not re-credit your account.
 
If we determine there was no error, we will mail you a written explanation within three (3) business days after we finish the investigation and reverse the funds provisionally credited to your account. You may ask for copies of documents that we used in our investigation. Refer to the AOD Federal Credit Union Electronic Fund Transfer Disclosure for more information.
 
Data Recording
 
When you contact the Service to conduct transactions, the information you enter may be recorded. By using the Service, you consent to such recording.
 
No Signature Required
 
When using the Service to conduct banking transactions, you agree that AOD Federal Credit Union may debit your account to complete the banking transactions, or honor debits you have not signed.
 
Disclosure of Account Information to Third Parties
 
We will disclose information to third parties about your account, or the banking transaction(s) you make only in the following situations:
 
1. Where it is necessary for completing banking transactions; or
 
2. In order to verify the existence and condition of your account(s) to a third party, such as a credit bureau; or
 
3. In order to comply with laws, government agency rules or orders, court orders, or officials having legal authority to request such information; or
 
4. If AOD Federal Credit Union has entered into an agreement to have another party provide the Service and the party has agreed to be bound by these disclosure standards; or
 
5. If you give us your written permission.
 
AOD Federal Credit Union also reserves the right to disclose information about your accounts(s), banking transactions, and payments to affiliated companies at AOD Federal Credit Union's discretion.
 

Alterations and Amendments
 
The terms of this Agreement, applicable fees, and service charges may be altered or amended by AOD Federal Credit Union from time to time. In such event, AOD Federal Credit Union shall send notice to you at your address as it appears on AOD Federal Credit Union records. Any continuation of the Service after AOD Federal Credit Union sends you a notice of change will constitute your agreement to such change(s). Further, AOD Federal Credit Union may, from time to time, revise or update the AOD Federal Credit Union program, services, and/or related material(s) rendering such prior versions obsolete. Consequently, AOD Federal Credit Union reserves the right to terminate this Agreement as to all such prior versions of the AOD Federal Credit Union programs, services, and/or related material(s) and limit access to AOD Federal Credit Union' more recent versions and updates.
 
Address Changes
 
You agree to promptly notify AOD Federal Credit Union, in writing, of any address change.
 
Termination or Discontinuation
 
The use of AOD eLink Home Banking Bill Payment Service requires enrollment on your behalf; therefore, termination of the Service by you is done by notifying AOD Federal Credit Union in writing. Neither termination nor discontinuation shall affect your liability or obligation under this Agreement. AOD will discontinue your service automatically after six months of inactivity. Reenrollment will be available utilizing your then-current VoiceLink Telephone Banking PIN number.
 
Disputes
 
In the event of a dispute regarding the Service, you and AOD Federal Credit Union agree to resolve the dispute by looking to this Agreement. You agree that this Agreement is the complete and exclusive statement of the agreement between you and AOD Federal Credit Union, which supersedes any proposal or prior agreement, oral or written, and any other communications between you and AOD Federal Credit Union relating to the subject matter of this Agreement. If there is a conflict between what one of AOD Federal Credit Union' employees says and the terms of this Agreement, the terms of this Agreement shall control.
 
Assignment
 
You may not assign this Agreement to any other party. AOD Federal Credit Union may assign this Agreement to any present or future, directly or indirectly, affiliated company. AOD Federal Credit Union may also assign or delegate certain of its rights and responsibilities under this Agreement to independent contractors or other third parties.
 
No Waiver
 
AOD Federal Credit Union shall not be deemed to have waived any of its rights or remedies hereunder unless such waiver is in writing and signed by AOD Federal Credit Union. No delay or omission on the part of AOD Federal Credit Union in exercising any right or remedy shall operate as a waiver of such right or remedy or any other rights or remedies. A waiver on any particular occasion shall not be construed as a bar or waiver of any rights or remedies on future occasions.
 
Captions
 
The captions of sections hereof are for convenience only and shall not control or affect the meaning or construction of any of the provisions of this Agreement.
 
Governing Law
 
The laws of the State of Alabama and by applicable Federal laws and regulations shall govern this Agreement.

Account Terms and Conditions

Rate Information

The dividend rate and annual percentage yield may change every month as determined by the credit union board of directors.

Compounding and Crediting

Dividends will be compounded every month. Dividends will be credited to your account every month. For this account type, the dividend period is monthly, for example, the beginning date of the first dividend period of the calendar year is January 1 and the ending date of such dividend period is January 31. All other dividend periods follow the same pattern of dates. The dividend declaration period is the last day of the dividend period, and for this example would be January 31. If you withdraw from or close a Certificate Account before the maturity date a penalty may be imposed. The amount of the early withdrawal penalty for your account is 90 days dividend. The penalty is calculated as a forfeiture of part of the dividends that have been or would be earned on the account. It applies whether or not the dividends have been earned. In other words, if the account has not yet earned enough dividends or if the dividend has already been paid, the penalty will be deducted from the principal. At our option, we may pay the account before maturity without imposing an early withdrawal penalty under the following circumstances: (1) When an account owner dies or is determined legally incompetent by a court or other body of competent jurisdiction (2) Where the account is an Individual Retirement Account (IRA) and any portion is paid within seven (7) days after the establishment; or where the account is a Keogh Plan provided that the depositor forfeits an amount of at least equal to the simple dividends earned in the amount withdrawn; or where the account is an IRA or Keogh and the owner attains age 59 ½ or becomes disabled.

Minimum Balance Requirements

The minimum balance required to open a savings account is the purchase of a $25.00 share in the credit union. You must maintain a minimum balance of $25.00 in your account to avoid a service fee. This fee is a Par Value fee of $5 and will be assessed on all share accounts that have reduced the balance below the Par Value ($25.00) of one share and does not increase the balance to at least the Par Value of one share within 30 days of the reduction. Some accounts may have additional minimum opening deposit requirements. For Plus Checking, there is minimum Average Daily Balance required to earn the Annual Percentage Yield disclosed for the dividend period. If the minimum average daily balance is not met, you will not earn the Annual Percentage Yield stated in the Rate Schedule.

Balance Computation Method

Dividends are calculated by applying a periodic rate to the Average Daily Balance in the account for the dividend period. The Average Daily Balance is calculated by adding the balance in the account for each day of the period and dividing that figure by the number days in the period. The Daily Balance method of computing dividends applies a daily periodic rate to the full amount of principal in the account each day.

Accrual of Dividends

For all accounts, dividends will begin to accrue on non-cash deposits (e.g. checks) on the business day you make the deposit to your account.

Transaction Limitations

Withdrawals are permitted only if the account has sufficient available funds to cover the full amount of the withdrawal or have an established overdraft protection plan. Drafts or other transfer or payment orders which are drawn against insufficient funds may be subject to a service charge set forth in the Rate and Fee Schedule. If there are sufficient funds to cover some, but not all, of the withdrawal, we may allow those withdrawals for which there are sufficient funds in any order at our discretion. We may refuse to allow a withdrawal in some situations, and will advise accordingly; for example (1) a dispute between account owners (unless a court has ordered the credit union to allow the withdrawal); (2) a legal garnishment or attachment is served; (3) the account secures any obligation to us; (4) required documentation has not been presented; (5) you fail to repay a credit union loan on time. We may require you to give written notice of seven (7) days to sixty (60) days before any intended withdrawals. For share, Christmas Club, and IRA Club, no more than six (6) preauthorized, automatic, or telephone transfers may be made from each account to another account or to a third party in any month, and no more than three (3) of these six (6) transfers may be made by check, draft, or debit card to a third party. However, we may refuse or reverse a transfer that exceeds these limitations and may assess fees against, suspend, or close your account. For Christmas Club accounts, the entire balance will be paid to you on or after November 1st and the account will remain open. If you close your regular Christmas Club account before dividends are credited to your account, you will receive dividends up to the day you closed your account. There will be a $10 fee for any withdrawal from a Christmas Club account, other than the disbursement you automatically receive in November. No fee will be charged if the withdrawal occurs within seven (7) days of the date the account is opened. For Freedom Classic Checking, Blue Ribbon Checking, First Choice Checking, AOD Gold, and Plus Checking accounts you may make unlimited transfers to any of your accounts or to any credit union loan account and make withdrawals in person or by mail. There is a $500 limitation on ATM withdrawals, a $3000 point of sale limit on debit cards, and a limit of ten (10) point of sale transactions per day. You are allowed dour (4) foreign ATM transactions per month a no charge. Each transaction after that will be assessed a fee of $1.

Nature of Dividends

Dividends are paid from current income and available earning after required transfers to reserves at the end of the dividend period.
